These Terms of Service ("Terms") govern your use of the DeepSage mobile application (the "App") operated by Shaanxi Zhenghua Information Technology Co., Ltd. ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms ​

By creating an account, accessing, or using the App, you confirm that:

  • You are at least 13 years of age (or the applicable age of digital consent in your jurisdiction)

  • Sending an email notification (if applicable)

Continued use of the App after changes constitutes acceptance of the updated Terms.

3. Use of the App ​

You may use the App for:

3.2 Prohibited Activities ​

You agree NOT to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Transmit viruses, malware, or harmful code
  • Attempt to hack, reverse engineer, or compromise the App
  • Use the App for automated scraping or data mining
  • Harass, abuse, or harm other users
  • Upload illegal, offensive, or inappropriate content
  • Use the App to generate spam or phishing content
  • Circumvent usage limits or payment requirements

3.3 Content Guidelines ​

When using the AI chat service, you agree not to:

  • Submit content that is illegal, harmful, or violates third-party rights
  • Request assistance with illegal activities
  • Submit content that is sexually explicit, violent, or promotes hate speech
  • Attempt to manipulate or abuse the AI system

4. Intellectual Property Rights ​

4.1 Ownership ​

All rights, title, and interest in the App, including:

  • Software code, algorithms, and machine learning models
  • User interface, design, and graphics
  • Trademarks, logos, and branding
  • Documentation and content

are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License ​

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes, subject to these Terms.

4.3 User Content ​

You retain ownership of content you submit to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process and analyze your content to provide AI services
  • Store your content for service delivery
  • Improve our AI models and services (in anonymized, aggregated form)

5. In-App Purchases and Payments ​

5.1 Virtual Currency ​

The App may offer virtual currency ("Points") for purchase through in-app purchases managed by RevenueCat.

5.2 Payment Terms ​

  • All purchases are processed through Apple App Store or Google Play Store
  • Prices are displayed in your local currency
  • All sales are final; refunds are subject to Apple/Google's refund policies
  • We reserve the right to modify pricing at any time

5.3 Subscription Terms (if applicable) ​

If the App offers subscription services:

  • Subscriptions automatically renew unless canceled
  • You may cancel anytime through your Apple/Google account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods

6. AI Services and Limitations ​

6.1 AI-Generated Content ​

The App uses artificial intelligence to generate responses and analysis. You acknowledge that:

  • AI responses may contain errors, inaccuracies, or outdated information
  • AI-generated content should not be considered professional advice
  • You should independently verify important information
  • We are not liable for decisions made based on AI responses

6.2 No Professional Advice ​

The App does not provide:

  • Legal, medical, financial, or professional advice
  • Guarantees or warranties regarding AI analysis accuracy
  • Liability for business decisions based on App content

6.3 Service Availability ​

We strive to provide reliable service but do not guarantee:

  • Uninterrupted or error-free operation
  • Compatibility with all devices and operating systems
  • Permanent availability of any feature

7. Privacy and Data Protection ​

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to:

  • Collection and processing of your data as described in the Privacy Policy
  • Use of cookies and similar technologies
  • Data transmission to our servers and third-party service providers

8. Disclaimers and Limitations of Liability ​

8.1 Disclaimer of Warranties ​

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability or fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content

8.2 Limitation of Liability ​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use or inability to use the App
  • Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8.3 Force Majeure ​

We are not liable for failures due to circumstances beyond our reasonable control, including:

  • Natural disasters, pandemics, or acts of war
  • Internet service disruptions or server failures
  • Government actions or legal restrictions

9. Indemnification ​

Any disputes shall be resolved exclusively in the courts located in Xi'an, Shaanxi Province, China.

11.3 Informal Resolution ​

11.4 Arbitration (if applicable) ​

For international users, disputes may be resolved through binding arbitration in accordance with international arbitration rules.

12. General Provisions ​

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.

Our failure to enforce any right does not constitute a waiver of that right.

You may not transfer these Terms without our consent. We may transfer our rights to any successor entity.

The App integrates with third-party services (Google, Apple, RevenueCat) subject to their respective terms and policies.

By using the DeepSage App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
